Acceptance of these Terms
Welcome to Afterwords. By creating an account, using our platform, or contributing content to any memorial on our service, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions, together with our Privacy Policy. If you do not agree with any part of these Terms, you should not use Afterwords.
These Terms form a legally binding agreement between you and Afterwords Story Collective Inc., a corporation based in Kelowna, British Columbia, Canada. Throughout these Terms, "Afterwords," "we," "us," and "our" refer to Afterwords Story Collective Inc. and its team. "You" refers to you, the user of our service — whether you are an account holder, a contributor, or a visitor to a memorial page.

About the Afterwords service
Afterwords is an online platform that allows you to create memorial pages honouring loved ones who have passed away. Through a memorial page, you can collect stories, photos, voice memos, and other memories from friends and family, and you can order printed Memory Books and Photo Albums. Our service also allows you to purchase memorial access as a gift for someone else.
We provide the tools to collect and display memorial content, but we are not the author or publisher of the content that you or your contributors create. The content belongs to the people who contribute it, and the memorial page belongs to the account holder who created it.
We may update, modify, or discontinue specific features of the service from time to time. We will provide notice of any significant changes that affect your use of the platform.

Creating and managing your account
To create a memorial on Afterwords, you must register for an account by providing your name and email address and choosing a password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you become aware of any unauthorized use of your account, you must notify us immediately.
You must be at least 18 years old to create an account on Afterwords. By registering, you confirm that you are 18 or older and that the information you provide is accurate and complete.
You may invite co-administrators to help manage your memorial. Co-administrators you invite share management privileges for the memorial, including the ability to edit the memorial profile, review submissions, and manage settings. You are responsible for the co-administrators you invite and should only invite people you trust.

Memorial pages and ownership
When you create a memorial, you become the account holder and primary owner of that memorial page. You control the memorial's content, settings, and visibility. You are responsible for ensuring that you have the appropriate rights and permissions to publish any biographical information, photographs, or other materials you add to the memorial, and that the content is accurate and respectful.
Memorial pages are accessible only via their unique, non-guessable URL. We do not publicly list or index memorial pages, and they are not discoverable through search engines or any public directory. You control who receives the link.
You may choose to close a memorial to new submissions at any time by updating the memorial's status. Closing submissions does not delete existing content — it simply prevents new contributions from being added.

Contributor submissions
Friends and family members can contribute to a memorial by submitting stories, photos, voice memos, and other memories. Contributors do not need an Afterwords account to submit content — they are invited through the memorial's unique link and provide their name and email address with each submission.
Contributors retain ownership of the intellectual property in the content they submit. By submitting content to a memorial, the contributor grants Afterwords and the memorial account holder a non-exclusive, royalty-free licence to display that content on the memorial page and to reproduce it in printed Memory Books or Photo Albums ordered by the account holder.
Contributors are responsible for ensuring they have the rights to any content they submit and that their submissions are accurate, respectful, and do not infringe on the rights of any third party.

Content moderation and your responsibilities
All submissions are automatically reviewed by our content moderation system at the time they are submitted. Content that passes moderation is published immediately to the memorial and is visible to anyone with the memorial link. If a submission is flagged by the moderation system, it is hidden from the gallery and the account holder is notified.
The account holder can remove, hide, or manage any submission at any time from the submissions dashboard. Afterwords does not manually review every submission before it appears — moderation is automated and the account holder has final control over what remains visible on their memorial.
Afterwords reserves the right to remove any content that we believe, in our sole discretion, violates these Terms, is unlawful, harmful, or otherwise inappropriate. We also reserve the right to suspend or terminate access for any user who repeatedly posts content that violates our policies.

Acceptable use policy
You agree not to use Afterwords to:
- Post content that is false, misleading, defamatory, hateful, harassing, threatening, or otherwise harmful to any person
- Infringe on the intellectual property, privacy, or other rights of any third party
- Upload content that you do not have the right or permission to share
- Attempt to gain unauthorized access to any part of the platform, another user's account, or our systems
- Use the service for any commercial purpose without our express written consent
- Interfere with or disrupt the service, including introducing viruses or other malicious code
- Collect or store personal data of other users without their consent
- Use the service in any way that violates applicable laws or regulations
Violations of this policy may result in content removal, account suspension, or permanent termination of access, at our discretion.

Intellectual property rights
The Afterwords platform — including its design, software, branding, text, and graphics — is owned by Afterwords Story Collective Inc. and is protected by Canadian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from the platform itself without our written permission.
Content submitted to memorials — by account holders or contributors — remains the property of the person who created it, as described in the sections on memorial ownership and contributor submissions above. Afterwords claims no ownership over your memorial content or contributor submissions.
You grant Afterwords a limited licence to host, store, display, and process your content solely for the purpose of operating the platform and producing printed books you order. This licence ends when you delete your content or your account.

Subscriptions, plans, and payments
Afterwords offers memorial access through paid subscription plans, including 3-month, 6-month, and monthly options. Plan details, pricing, and features are displayed on our pricing page and may change from time to time. The terms in effect at the time of your purchase govern your subscription.
Payments are processed securely through Stripe. We do not see or store your credit card information. By purchasing a plan, you authorize Stripe to charge the selected payment method for the full amount of the plan.
For monthly plans, your subscription renews automatically until you cancel it. You can cancel at any time from your dashboard. Cancellation stops future renewals but does not refund the current billing period. Fixed-term plans (3-month and 6-month) provide access for the duration selected and do not auto-renew.
If your subscription expires, your memorial content is preserved privately for one year. During this period, the memorial is set to private and new submissions are paused. You can renew at any time within that year to restore full access. If you do not renew within one year, your account and all associated content may be permanently deleted.
Coupons and promotional codes, when offered, are subject to the specific terms communicated with each offer and may be modified or withdrawn at any time.

Printed books and physical products
Afterwords offers printed Memory Books and Photo Albums produced from the content collected on your memorial. These are produced on demand by our printing partners and shipped to the address you provide at checkout.
Book prices are listed at the time of order and do not include shipping, which is calculated at checkout. Production and delivery times are estimates and may vary depending on your location and our printing partners' schedules.
If you receive a printed product that is damaged or defective, please contact us within 14 days of delivery and we will arrange a replacement. Due to the personalized nature of these products, we are unable to offer refunds for books that have already been printed, except in cases of damage or production error on our part.
You are responsible for ensuring the content you include in a printed book is accurate and that you have the rights to print and distribute all included materials.

Memorial gifts
Afterwords allows you to purchase memorial access as a gift for another person. When you purchase a gift, payment is processed at the time of purchase, and the recipient receives a notification email with a link to claim and set up their memorial.
The gift recipient must claim their memorial by following the link in the notification email. If the recipient does not claim the gift, the purchase remains valid and the gift link remains active. If you believe a gift was sent in error, please contact us and we will do our best to assist.
Once a gift has been claimed and a memorial has been created, the recipient becomes the account holder and is responsible for managing the memorial under these Terms.

Disclaimer of warranties and limitation of liability
Afterwords is provided on an "as is" and "as available" basis. While we are committed to providing a reliable and secure service, we do not guarantee that the platform will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Afterwords Story Collective Inc. and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the service — whether based on warranty, contract, tort (including negligence), or any other legal theory.
Our total aggregate liability for any claim arising out of or related to these Terms or your use of the service shall not exceed the amount you have paid to Afterwords in the 12 months preceding the claim, or one hundred Canadian dollars (CAD $100), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Cancellation and account termination
You can cancel your subscription at any time from your dashboard. For monthly plans, cancellation stops future renewals but does not refund the current billing period — you retain access until the end of the period you have paid for. Fixed-term plans cannot be cancelled mid-term for a refund, but you retain access for the full term.
You can request full account deletion at any time by contacting us. Account deletion permanently and irreversibly removes your memorial, all submitted content, photos, and account information within 30 days of your request. Payment transaction records are retained for up to 7 years as required by Canadian financial and tax law, but contain no card data.
Afterwords may suspend or terminate your account if you violate these Terms, if your account remains inactive for an extended period, or if we are required to do so by law. We will provide notice where possible, except in cases of serious or repeated violations.
Upon termination for any reason, the licences granted to you under these Terms end immediately. Provisions that by their nature should survive termination — including those related to intellectual property, limitation of liability, and governing law — will remain in effect.

Changes to these Terms
We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices. When we make material changes, we will notify all registered account holders by email before those changes take effect, describing what has changed and why.
Continued use of Afterwords after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you may request account deletion before the effective date.

Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable therein. You and Afterwords agree to the exclusive jurisdiction of the courts of British Columbia for the resolution of any dispute arising out of or related to these Terms or your use of the service.
Before initiating court proceedings, we encourage both parties to attempt to resolve disputes informally. If informal resolution is not possible, either party may pursue the matter in the courts of British Columbia.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
